DIRECT DEBIT MEMBERSHIPS
Monthly Membership - I understand that I am signing into a monthly agreement, payable by one pro-rata payment upon joining, followed by a minimum of 12 monthly direct debit payments.

I may freeze my membership for one month at Christmas, Easter and Summer Holidays by calling the number on my membership card. I understand that I must provide student identification before I am issued with my membership card and before I can gain access to the facilities. Failure to do so will result in the termination of my membership.

I understand that I must provide my employers name and proof that I am a current employee at this company. I agree to inform SIV of any changes to my employment status.
I understand that my membership (direct debit payments) will continue beyond the minimum terms highlighted above until I contact Fitness Unlimited to inform them of my wish to cancel my membership. I can do this by calling the number on the back of my membership card giving a minimum of one months notice.

I understand that failure to make my monthly payments will result in my membership being suspended - I may be refused access to the venues and asked to contact the membership department to make arrangement for payment. I understand that even if my membership is suspended that I am still liable to pay.
I understand that failure to fulfil my minimum number of payments may result in a third party being instructed to collect monies owed. The cost of this instruction will be passed onto me.
UPFRONT MEMBERSHIPS
3 / 6 / 12 / 24 Month Membership (one instalment) - I understand that this membership cannot be refunded and is payable in full on joining the scheme.

I understand that my membership cannot be downgraded during my initial contract.
I understand that I must adhere to the Etiquette Rules at each venue
1. Definitions
1.1 SIV: Sheffield International Venues Limited (co. no. 2226575)
1.2 Members: people we accept to become members of the Scheme, being aged 16 or above. If the Member is under the age of 18 years the Members parent or guardian must act as a guarantor for the membership and will be responsible for the payment of the membership.
1.3 Minimum Term: The minimum period, during which your membership of the Scheme will last, as specified in the Membership Application Form, starting on the date we notify to you.
1.4 Scheme: the membership scheme run by SIV which you have agreed to join, as referred to in the Membership Application Form.
1.5 Venues: fitness venues operated by SIV where Fitness Unlimited is available.
2. Membership Entitlement
2.1 Membership of the Scheme gives you the right to use certain facilities and activities operated by SIV, as specified in relation to the Scheme, subject to the exclusions outlined below.
2.2 Each Venue has its own individual management rules, which we may change or alter from time to time. Copies of the individual rules are available on request. You must comply with the management rules for the facility and the Venue that you are using.
2.3 At certain times, access to or use of a particular Venue or activity may not be possible. You will not be entitled to any refund or compensation should this happen.
2.4 We reserve the right to alter the terms of the Scheme (including these Terms and Conditions) at any time, by, for example, amending the list of facilities and venues that can be used under the Scheme, altering the activities offered at each Venue and varying the times at which off peak membership applies. Where a change is proposed that is more than minor or technical (for example, an increase in membership fees) you will be given no less than 28 day’s notice. SIV reserves the right to reject an application for membership of the Scheme for any reason and will not be liable to you in respect of any such rejection.
2.5 You will comply with the conditions of use applying to each Venue from time to time, however, if there is a conflict between these Terms and Conditions and the conditions of use for any Venue, these Terms and Conditions will prevail.
2.6 SIV reserves the right following your gym induction to ask for appropriate documentation to prove that it is appropriate for you to enter into this Agreement. This includes, without limitation, a doctor’s certificate of fitness to exercise or certificate of fitness to enter into this contract. Where such documentation is requested your Membership will be suspended until the documentation is provided and you will not be entitled to use any of the facilities referred to in clause 2.1.
2.7 Certain categories of Member may not have access to all of the facilities at each Venue included in the Scheme.
3. Membership Term and Fees
3.1 You will be a FU Member for no less than the Minimum Term. Membership cannot be upgraded or downgraded during the Minimum Term. All Golfit Memberships are for a minimum term of 12 months.
3.2 All memberships will automatically continue after the Minimum Term unless terminated.
3.3 “Membership fees are payable monthly in advance. If your membership is terminated, you must pay any unpaid amounts, including but not limited to amounts in respect of the minimum term immediately. No refund will be made in respect of the part of the relevant month falling after the date of termination.”
3.4 You must pay the first month’s membership fee by cheque, cash or debit card on joining. All subsequent payments (throughout the Minimum Term and beyond) must be made by Direct Debit.
3.5 We reserve the right to increase the membership fees from time to time following the expiry of the Minimum Term. We will notify you of any increase we propose to make no less than 28 days before your next Direct Debit payment at which the increased fee is due.
3.6 If any payment whatsoever remains outstanding, SIV will give written notice that your membership is suspended pending payment of the outstanding sum. Until such time as payment is received, you will not be entitled to use any of the facilities referred to in clause 2.1. Following completion of the Minimum Term, your contract may be terminated by us and will not be reactivated unless the outstanding sums are paid.
3.7 Once we have received payment of the outstanding sums, you will be entitled to use the facilities and activities once more, but you will not be given any credit for the time that your membership was suspended.
3.8 If you fail to pay any amount due under this agreement for a period of more than 30 days, then we may pass the debt to a third party company for collection. The cost of this instruction will be borne by you, including costs in tracing you should you have changed address.
4. Corporate Membership
4.1 SIV will administer corporate membership packages on behalf of corporate partners. The management and promotion of these schemes internally to corporate partners’ employees rests with the corporate partners and not SIV.
4.2 Corporate members and their partners must provide SIV with a current wage slip proof of their employees’ employment status in order for them to receive the preferential rate.
4.3 We reserve the right to contact your employer at anytime to confirm your continued employment and therefore your eligibility to the scheme.
4.4 Existing Members wishing to convert to a corporate package must give us 28 days notice. The corporate rate cannot be backdated for existing Members who transfer to a corporate scheme.
4.5 SIV reserves the right to alter the Terms and Conditions of corporate membership at any time.
4.6 Membership cards remain the property of SIV at all times and must be returned once you leave your employment.
5. Membership Card
5.1 On joining the Scheme you will be issued with a membership card.
5.2 This card is personal to you. You must not allow anyone else to use your card to gain access to any Venue. Any fraudulent use of your membership card will result in cancellation of your membership with no refund being given.
5.3 The membership card must be presented on each visit to a Venue in order to gain access to the facilities.
5.4 There will be an administrative charge for the replacement of lost or stolen cards. Replacement cards can be purchased from the Venues.
5.5 Membership cards remain the property of SIV at all times.
6. Limitation of Liability
6.1 We, our agents and employees will not be liable for any loss or damage to property or personal belongings that are brought in to any of the Venues save to the extent that such loss or damage is directly caused by our negligence, or that of our agents, servants or employees.
6.2 We do not seek to exclude or limit our liability for fraudulent misrepresentation or death or personal injury caused by our negligence, or that of our agents, servants or employees.
6.3 We, our agents and employees will not be liable for any indirect or consequential loss or damage (including loss of profits) suffered by you or any other person.
7. Termination
7.1 Upon termination of your membership for whatever reason, it is your responsibility to make the necessary arrangements with your bank to cancel the Direct Debit in respect of membership fees.
7.2 If you decide to terminate your membership of the Scheme at any time after the Minimum Term or you become entitled to terminate under clause 2.4, you should do so in writing or by telephone to the address provided in clause 8.1.
7.3 Notice of termination should be received by us at least 10 days before the next Direct Debit payment is due. Failure to do so will result in another month’s payment being due before the membership is terminated.
7.4 A minimum of 3 months notice is required to terminate membership of the Golfit Scheme. A reactivation fee of £120 will be required if a Member wishes to return to the Golfit Scheme
7.5 We may terminate your membership if you:
• breach any material condition contained herein; or
• persistently breach any condition of this Agreement after having received written notice advising of the breach and warning that continuing to breach the Agreement may lead to termination of your membership.
7.6 We will provide one month’s notice of termination, except where there are serious grounds for termination, including but not limited to theft from the premises, deliberate damage to the premises or to property brought on to the premises, abuse of the membership or behaviour that may reasonably involve serious risk to us or other people using or visiting the Venues. In such circumstances, membership may be terminated with immediate effect.
7.7 You will surrender your membership card to us forthwith upon termination should we so request.
8. Notices
8.1 Any queries on membership should be addressed to the Membership Department, Head Office, Don Valley Stadium, Worksop Road, Sheffield, S9 3TL, tel: 0845 451 5355.
8.2 If we need to contact you, we will write to you at the address that you provided when you joined. If your address changes, please notify us as soon as possible.
9. Previous Memberships
9.1 You hereby agree that prior to joining this Scheme you have provided details of any previous scheme of which you were a member either in relation to Fitness Unlimited or any other similar scheme provided by SIV. Failure to disclose these details at the time of joining this scheme will allow SIV to terminate this agreement for breach of contract.
9.2 You hereby agree that at the time of joining the Scheme or immediately before where you have received a notice of an outstanding amount which you owe to SIV under any previous membership scheme that you unconditionally authorise SIV to recover this amount as part of the first payment to be taken by Direct Debit and that you acknowledge that it is in consideration of this payment that SIV is entering into this agreement for a new membership Scheme.
10. General
10.1 These Terms and Conditions do not affect your statutory rights.
10.2 If any of these terms are found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid, void, unenforceable or unreasonable, they shall be deemed severable and shall not affect the validity or enforceability of the other 10.3 Terms and Conditions contained herein.
10.4 These Terms and Conditions are governed by and construed in accordance with English Law and the parties hereby agree to submit any disputes to the exclusive jurisdiction of the English Courts.

11. Tennis Unlimited - Additional Terms & Conditions
11.1 Members are allowed unlimited access to outdoor tennis courts
11.2 Members are allowed unlimited access to off peak indoor tennis courts
11.3 Members may book up to 2 hours per week at peak / weekend periods. Hours booked must be on different days
A week is classed as Monday - Sunday
11.4 2 x tennis unlimited members per court are required to access the court with no additional charge
11.5 Where a member plays with a none member then an additional charge for the court price will be applied
11.6 Members are permitted access to all SIV fitness facilities, including fitness classes and swimming pools
11.7 Group coached tennis activities are not included in the scheme
11.8 Membership subscription is for a minimum of 12 months
11.9 All tennis court bookings are subject to availability
